OVERVIEW

Welcome to Cultshot Craft. The terms “we,” “us,” and “our” refer to Cultshot Craft, an Ontario business operating from Toronto, Canada.

Cultshot Craft operates this online store and website, including the related information, content, features, products, and services offered through it, collectively referred to as the “Services.” Our store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with our Privacy Policy, Refund Policy, Shipping Policy, and any other policies referenced on our website, describe your rights and responsibilities when using the Services.

By visiting our website, placing an order, or otherwise using the Services, you agree to these Terms. If you do not agree to these Terms, you should not use the Services.

Nothing in these Terms limits any consumer right that cannot be excluded under applicable law.

SECTION 1: ELIGIBILITY AND ACCOUNTS

You must be at least the age of majority in your province, state, territory, or country of residence to place an order through the Services.

You agree to provide accurate, current, and complete information when creating an account or placing an order, including your email address, billing information, shipping address, and payment information.

You are responsible for maintaining the confidentiality of your account credentials and for activity performed through your account. You may not transfer or sell your account to another person.

SECTION 2: PRODUCTS AND HANDMADE CHARACTERISTICS

We make reasonable efforts to describe and display our products accurately. However, colours may appear slightly different depending on your screen, device settings, lighting, and photography.

Many Cultshot Craft products are handmade, 3D printed, made to order, or personalized. Minor variations in colour, texture, layer lines, placement, dimensions, and finish can occur. These are normal characteristics of the manufacturing process and are not necessarily defects.

Product dimensions are approximate unless expressly stated otherwise. Accessories, decorations, game cards, containers, or other objects shown in product photographs are not included unless the product description specifically states that they are included.

Nothing in this section affects your rights if an item arrives damaged, defective, incorrect, or materially different from its description.

We may modify or discontinue products and limit the quantity available to a customer, location, or jurisdiction.

SECTION 3: PERSONALIZATION AND CUSTOM ORDERS

You are responsible for reviewing all personalization details, spelling, colours, sizes, designs, and other options before submitting your order.

We will produce personalized products based on the information submitted with the order. We are not responsible for errors contained in personalization information provided by the customer.

We may contact you if clarification is required. Delays in receiving a response may delay production and delivery.

We reserve the right to reject personalization requests that are unlawful, hateful, threatening, discriminatory, obscene, or otherwise inappropriate.

If you provide text, photographs, graphics, logos, or other materials for customization, you confirm that you have the necessary rights or permission to use and provide those materials. You remain responsible for content supplied by you.

SECTION 4: ORDERS AND ACCEPTANCE

Placing an order constitutes an offer to purchase. An automated order confirmation does not necessarily mean that we have accepted the order.

We reserve the right to decline or cancel an order when reasonably necessary, including because of suspected fraud, payment problems, pricing or inventory errors, an unavailable shipping destination, an inappropriate personalization request, or an inability to complete the requested product.

If we cancel an order after payment has been processed, we will refund the applicable amount to the original payment method.

Please review your order carefully before submitting it. Changes or cancellations may not be possible once production has started. All cancellations, returns, exchanges, and refunds are governed by our Refund Policy.

SECTION 5: PRICES, TAXES, AND PAYMENT

Prices are displayed in the currency indicated on the website and may change without notice. The price charged will be the price displayed when the order is submitted, subject to the correction of obvious pricing errors.

Applicable taxes and shipping charges will be displayed during checkout when they are collected by us.

For international orders, customs duties, import taxes, brokerage charges, handling fees, or other charges may be imposed by the destination country. When these amounts are not collected during checkout, they are generally the customer’s responsibility.

We cannot control or predict charges imposed by foreign customs authorities. Refusing delivery because of unpaid customs or import charges does not automatically entitle the customer to a refund. Any refund available in those circumstances will be determined in accordance with our Refund Policy and applicable law.

You agree to provide accurate payment information and confirm that you are authorized to use the payment method submitted with the order.

SECTION 6: SHIPPING DESTINATIONS

We currently do not ship to the United States or its territories. Orders with a United States delivery address may be declined or cancelled and refunded.

We may ship within Canada and to selected international destinations, including certain European countries and other destinations supported by our available shipping carriers.

Available countries may change because of carrier availability, customs restrictions, service interruptions, legal requirements, cost, or other operational considerations. A country appearing as an available destination during checkout does not guarantee that every product can be shipped there.

If we are unable to ship an accepted order to the destination provided, we will contact the customer and cancel and refund the affected order when necessary.

Customers are responsible for confirming that products may legally be imported into their destination country.

SECTION 7: SHIPPING AND DELIVERY

Processing time and shipping time are separate. Processing time refers to the time required to create and prepare an order. Shipping time begins after the order has been transferred to the carrier.

Delivery dates and transit times are estimates unless expressly guaranteed in writing. Delivery may be affected by customs processing, weather, carrier delays, service interruptions, holidays, or events outside our reasonable control.

Customers are responsible for providing a complete and accurate delivery address. Additional shipping charges resulting from an incorrect or incomplete address provided by the customer may be the customer’s responsibility.

If an order is delayed, lost, returned, or arrives damaged, contact us at cultshotcraft@gmail.com so that we can investigate and determine an appropriate resolution.

Nothing in this section limits any cancellation, refund, delivery, or consumer rights that cannot legally be excluded.

SECTION 8: RETURNS, EXCHANGES, AND REFUNDS

Returns, exchanges, cancellations, and refunds are governed by our Refund Policy.

Because many of our products are personalized, custom-made, or produced specifically for an order, they may not be eligible for return or exchange because of a change of mind.

This does not exclude assistance or an appropriate resolution when an item arrives damaged, defective, incorrect, or materially different from what was ordered.

Customers in the European Union and other jurisdictions may have mandatory consumer rights. Where a statutory withdrawal right applies, we will respect that right.

Products made according to a customer’s specifications or clearly personalized may be excluded from the European Union’s 14-day withdrawal right, as permitted by applicable law. Additional details are provided in our Refund Policy.

SECTION 9: INTELLECTUAL PROPERTY

The original website content created by Cultshot Craft, including original text, photographs, graphics, branding, logos, videos, and original product designs, is owned by or licensed to Cultshot Craft and is protected by Canadian and applicable international intellectual property laws.

You may use the website for personal and non-commercial purposes only. You may not reproduce, distribute, modify, republish, sell, commercially exploit, or create derivative works from protected website content without prior written permission.

Third-party names, characters, trademarks, logos, and other intellectual property displayed or referenced on the website remain the property of their respective owners. Unless expressly stated, references to third-party products or brands do not imply sponsorship, authorization, affiliation, or endorsement.

SECTION 10: THIRD-PARTY SERVICES AND LINKS

Our Services may include tools, applications, payment services, shipping services, or links operated by third parties.

Your use of third-party services may be governed by the terms and privacy policies of those providers. We are not responsible for third-party websites, services, content, or practices that are outside our reasonable control.

Please review the applicable third-party terms before using their services or completing a transaction through them.

SECTION 11: RELATIONSHIP WITH SHOPIFY

Cultshot Craft is powered by Shopify, which enables us to provide the Services to you. However, purchases made through our store are transactions directly between you and Cultshot Craft.

Shopify is not the seller of our products and is not responsible for the products, personalization, production, shipping, or customer service provided by Cultshot Craft.

Nothing in this section limits any responsibility Shopify may have that cannot legally be excluded.

SECTION 12: PRIVACY

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because the Services are hosted by Shopify, Shopify and other service providers may collect and process information required to operate the store, process payments, prevent fraud, fulfill orders, provide analytics, and improve the Services.

Information may be processed in countries other than the country where you reside. Please review our Privacy Policy and Shopify’s applicable privacy information for further details.

SECTION 13: REVIEWS AND FEEDBACK

If you submit a review, photograph, suggestion, comment, or other feedback, you grant Cultshot Craft a non-exclusive, worldwide, royalty-free licence to use, reproduce, display, and share that content for operating and promoting the business, subject to applicable privacy and consumer protection laws.

You confirm that you have the right to submit the content and that it does not violate another person’s intellectual property, privacy, or other legal rights.

We may remove content that is unlawful, abusive, misleading, discriminatory, obscene, fraudulent, or unrelated to the product or Services. We will not suppress or alter legitimate reviews merely because they are critical.

SECTION 14: ERRORS AND INACCURACIES

Occasionally, the website may contain typographical errors, inaccuracies, or omissions concerning product descriptions, availability, prices, promotions, shipping charges, or estimated delivery times.

We may correct errors and update information. If an error materially affects an order that has already been placed, we will contact the customer and provide an appropriate opportunity to confirm or cancel the affected order.

SECTION 15: PROHIBITED USES

You may not use the Services:

For an unlawful or fraudulent purpose.
To violate applicable federal, provincial, territorial, state, local, or international laws.
To infringe the intellectual property, privacy, or other legal rights of Cultshot Craft or another party.
To harass, threaten, abuse, defame, or discriminate against another person.
To submit false, deceptive, or misleading information.
To upload or transmit malware, viruses, or harmful code.
To interfere with the security, functionality, or operation of the Services.
To collect personal information about other users without authorization.
To use unauthorized automated systems, scrapers, or data extraction tools in a manner that disrupts the Services, bypasses technical restrictions, or collects protected content or personal information without authorization.

We may restrict or terminate access to the Services when we reasonably believe these Terms have been violated.

SECTION 16: DISCLAIMER OF WARRANTIES

We make reasonable efforts to keep the Services available, accurate, and secure. However, we do not guarantee that access to the website will always be uninterrupted, timely, secure, or error-free.

To the extent permitted by law, the Services are provided on an “as available” basis. This section does not exclude any product warranty, condition, remedy, or consumer right that cannot legally be excluded or limited.

SECTION 17: LIMITATION OF LIABILITY

To the extent permitted by applicable law, Cultshot Craft will not be liable for indirect, incidental, special, punitive, or consequential losses arising from the use of the Services or products purchased through the Services.

Nothing in these Terms excludes or limits liability for fraud, intentional misconduct, gross negligence, personal injury caused by negligence, or any other liability or consumer right that cannot legally be excluded or limited.

SECTION 18: INDEMNIFICATION

To the extent permitted by law, you agree to compensate Cultshot Craft for reasonable losses, liabilities, and expenses resulting directly from your unlawful use of the Services, your material breach of these Terms, or content supplied by you that violates another party’s rights.

This section does not apply to losses caused by Cultshot Craft or to liabilities that cannot legally be transferred to a consumer.

SECTION 19: TERMINATION

We may suspend or terminate access to the Services if you materially violate these Terms, engage in fraud, misuse the website, or threaten the security or operation of the Services.

Termination does not affect rights or obligations arising before termination, including payment obligations and provisions that reasonably need to continue after termination.

SECTION 20: SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted or severed from the Terms. The remaining provisions will continue in effect.

SECTION 21: WAIVER AND ENTIRE AGREEMENT

Our failure to enforce a provision of these Terms does not waive our right to enforce it later.

These Terms and the policies incorporated by reference constitute the entire agreement concerning your use of the Services and supersede previous communications concerning the same subject.

SECTION 22: ASSIGNMENT

You may not transfer your rights or obligations under these Terms without our written consent.

We may transfer our rights and obligations as part of a sale, reorganization, transfer, or restructuring of the business, subject to applicable law.

SECTION 23: GOVERNING LAW

These Terms and any separate agreements through which we provide the Services are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein.

Subject to mandatory consumer rights that may apply in the customer’s place of residence, the courts of Ontario will have jurisdiction over disputes arising from these Terms or the Services.

SECTION 24: CHANGES TO THESE TERMS

We may update these Terms by posting a revised version on the website. Material changes will take effect on the date stated in the updated Terms or as otherwise required by law.

The Terms in effect when an order was placed will continue to govern that purchase unless a change is required by law.
